Terms of Service

1. Acceptance of Terms

By accessing this website or requesting an operations audit or web development services from Content Operations Department LLC ("we", "our", or "us"), you agree to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

2. Scope of Services & Deliverables

  • One-Time Builds: For one-time purchases, services include the initial design, development, and deployment of the website based on the approved prototype or scope. Upon final payment, complete code repositories, domain DNS settings, and hosting management are transferred to the Client.
  • Managed Subscriptions: For subscription-based plans ($197/mo or custom recurring tiers), services include web hosting management, SSL certificate upkeep, Google API (Maps/Reviews) maintenance, domain DNS monitoring, and up to 1 hour per calendar month of minor content updates (e.g., updating text, business hours, or swapping existing photos). Unused maintenance hours do NOT roll over month-to-month.

3. Out-of-Scope Work & Additional Rates

  • Any work exceeding the included 1-hour monthly maintenance limit—including structural page redesigns, adding new pages, copywriting, blogging, custom features, or branding—is considered out-of-scope.
  • Out-of-scope requests will be quoted separately as a flat project fee or billed at our standard rate of $75.00/hour upon Client approval.

4. Subscription Terms & Minimum Commitment

  • All recurring website subscriptions carry a mandatory 6-month minimum term commitment unless explicitly stated otherwise in writing.
  • Early Cancellation: If the Client cancels their subscription before fulfilling the initial 6-month term, the Client agrees to pay the remaining balance of the minimum term commitment.

5. Ownership, Code Transfers & Migration Fees

  • For clients on an active managed subscription, all website source code, repository access, and hosting infrastructure remain under company management.
  • If a Client wishes to cancel their subscription and transfer site code, domain DNS management, and hosting to a third-party or client-owned account, a $150.00 Site Migration & Transfer Fee applies, in addition to any remaining balance on the initial build or minimum contract term.

6. Audit Requests & Eligibility

Our free systems analysis audits are provided to businesses, contractors, and corporate operations managers looking to optimize their operational workflows. We reserve the right to refuse or cancel audit generation for requests containing inaccurate contact details, competitor profiling, or spam.

7. 10DLC SMS & Text Communication Terms

If you choose to submit your mobile number via our audit portal, you explicitly opt-in to receive automated notifications, updates, and reminders via SMS.

  • Message Frequency: Message frequency varies depending on your engagement status (typically 2-4 messages during the audit delivery process).
  • Rates: Standard message and data rates may apply depending on your mobile carrier plans.
  • Opt-Out: You can cancel the SMS service at any time. Just reply STOP to any message we send. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed.
  • Support: If you experience issues with the messaging program, reply with the keyword HELP for more assistance.

8. Intellectual Property

The visual components, grid animations, custom workflow nodes, layouts, and audit checklists displayed on this website are the intellectual property of Content Operations Department LLC and are protected by applicable copyright and trademark law.

9. Limitation of Liability

In no event shall Content Operations Department LLC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on this website or the results of the operations audit.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of Delaware, and you irrevocably submit to the exclusive jurisdiction of the courts in that State.
